Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern access to and use of TimeToSell.AI websites, applications, APIs, reports, and related products (collectively, the “Service”) operated by GEOSOCIAL REALITY LLC (“TimeToSell.AI,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a brokerage or company, you represent that you have authority to bind that entity, and “you” includes that entity.

Our Privacy Policy explains how we handle personal information and is incorporated by reference.

2. Use of the Service

You may use the Service only for lawful professional purposes related to real-estate practice (including prospecting, farming, market research, and client communication where permitted).

You agree not to:

• Scrape, bulk-export, or systematically harvest data beyond features we expressly provide;
• Share, sell, or sublicense your account or non-public data feeds without our written consent;
• Interfere with security, rate limits, or other users’ access;
• Use the Service to spam, harass, discriminate, or violate telemarketing, email, or fair-housing laws;
• Misrepresent TimeToSell.AI outputs as guarantees or as legal, tax, or financial advice;
• Reverse-engineer or attempt to extract model weights, proprietary scoring logic, or non-public datasets except as allowed by law.

We may suspend access for suspected abuse, non-payment, or legal risk.

3. Accounts and eligibility

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account.

Certain features are limited to verified real-estate professionals. We may require license or brokerage verification and may refuse or revoke access if information is inaccurate or use is inappropriate.

4. Territory Farm product

Territory Farm is a subscription for one or more exclusive seats on named communities or areas that TimeToSell.AI has released for farming. While a seat is in an active paid period:

• You hold exclusivity for that named territory for Service purposes (not a legal claim on the geographic market or MLS);
• TimeToSell.AI may rank properties and owner situations in that territory and surface priority contacts in /app;
• Optional AI Manager / outreach under your name requires separate consent and can be turned off without ending the seat during the paid period;
• You remain responsible for all communications, compliance, and client relationships.

Territory Farm is not a shared lead pool, not a bulk statewide data dump, and not a promise of listings, appointments, or closings. Inventory of open seats is limited; TimeToSell.AI decides which communities are released and when.

Legacy per-lead or package products, if still visible on your account, may remain subject to their original purchase terms until fulfilled or retired. New commercial emphasis is Territory Farm as described here and in section 4A.

4A. Territory Farm Terms — version farm-2026.1

Effective / last aligned: August 17, 2026. These Farm Terms control if they conflict with older marketing copy about “pause” or per-lead refunds for Farm seats.

4A.1 Seat

One Farm seat = exclusive Service rights to work one named community or area while the seat is in an active paid period. Seat counts drive volume pricing.

4A.2 Billing cycle (anniversary)

Each Farm subscription period runs on an anniversary cycle from activation (or the current period start we show in-product).

Example: If you subscribe on the 17th of a month, the current paid period runs through the 16th of the following month (end of that day), unless a different period end is displayed at checkout or on the farm page.

Monthly price is the total for the number of territories you hold, as shown before you confirm. Introductory rates, when offered, apply only for the stated intro window (for example, first three paid months), then standard rates apply.

4A.3 No refunds

Fees for a paid period are non-refundable. Payment covers exclusivity and Service access for that full period. We do not provide cash refunds to your card for early cancel, non-use, or change of mind.

4A.4 Cancel

You may cancel renewal at any time in the product (or by contacting support if the control is unavailable).

• Cancel stops the next renewal charge;
• You keep the exclusive seat until the end of the current paid period;
• After period end, the seat status becomes ended, exclusivity for that community ends, and the community may become available to another agent;
• TimeToSell.AI may retain account and activity history associated with your use of the Service.

Canceling mid-period does not entitle you to a partial refund for unused days.

4A.5 No “pause seat” product

There is no separate product that pauses billing while indefinitely holding exclusivity. Operational controls (for example, turning outreach off) do not extend the paid period or create a free hold on the territory.

4A.6 Outreach

Optional outreach to homeowners under your name requires affirmative consent (version farm-outreach-2026.1 or successor). You can disable outreach without canceling the seat during the paid period. You are responsible for the content and compliance of messages sent as you.

4A.7 Adding or removing territories

Adding a territory updates your seat count and monthly total as shown at confirmation. Removing a territory via cancel follows §4A.4 for that seat. Where multiple seats share billing, we may align renewals to the account anniversary we display.

5. Fees, payment, and Wallet

Prices are shown in-product before you confirm a charge. You authorize us (and our payment processors) to charge the payment method you provide for subscription totals and any taxes required by law.

Territory Farm: billed per §4A (anniversary periods, volume totals, no cash refunds).

Wallet / credits (if available on your account): Wallet balances are promotional or service credits for use on the Service only. Unless required by law, Wallet credits are not redeemable for cash. Legacy undelivered per-lead value, if any, may be reflected as Wallet credit under older package rules and is not a card refund.

Failed payments may result in past-due status, suspension of seats, or termination after notice.

6. Cancellation and termination

By you (Farm): as in §4A.4 — cancel renewal; access and exclusivity through period end; no refund.

By you (account): you may request account closure; active Farm periods may still run to period end unless we agree otherwise in writing.

By us: we may suspend or terminate access for breach of these Terms, unlawful use, non-payment, or risk to the Service or others. If we terminate solely for convenience without your breach, we may provide a pro-rated Service credit or equivalent at our discretion; card refunds remain not the default remedy.

Upon final end of a Farm seat, priority routing and exclusivity for that community cease. Upon account termination, your right to use the Service ceases subject to data retention in our Privacy Policy.

7. User data and privacy

You are responsible for data you submit (including accuracy of profile and outreach identity). We process personal data as described in the Privacy Policy.

Market Intelligence reports and public pages are designed to avoid displaying personal owner identifiers. Non-public property and owner intelligence inside authenticated tools is for your professional use under these Terms and applicable law.

8. AI outputs and professional judgment

Indexes, seller/owner profiles, timing windows, Market Intelligence narratives, and related AI or statistical outputs are informational. They may be incomplete or wrong. They are not legal, tax, appraisal, or investment advice and not a guarantee that any person will sell, buy, or respond.

You must apply independent professional judgment and comply with brokerage policies, MLS rules, advertising law, and do-not-contact requests.

9. Intellectual property

The Service, including software, models, scores, report formats, branding, and documentation, is owned by GEOSOCIAL REALITY LLC and its licensors. No license is granted except the limited right to use the Service as permitted under your subscription.

“TimeToSell,” “TimeToSell.AI,” and related marks are trademarks of GEOSOCIAL REALITY LLC. You may not use them in a way that confuses sponsorship or endorsement without permission.

Suggested citation for public Market Intelligence reports may be provided on those pages and does not transfer ownership of underlying data or models.

10. Disclaimers and limitation of liability

No warranty. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIMETOSELL.AI AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, LISTINGS, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) TWO HUNDRED U.S. DOLLARS (US $200).

11. General

These Terms are governed by the laws of the State of Colorado, excluding conflict-of-law rules. Courts in Denver, Colorado, shall have exclusive jurisdiction over disputes, except where prohibited by law.

If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. We may update these Terms by posting a new version with an updated date; material changes to Farm billing will be reflected in-product and in §4A versioning where applicable.

These Terms and the Privacy Policy are the entire agreement regarding the Service and supersede prior conflicting terms for Territory Farm seats under farm-2026.1.
